Acuity is a study creation and distribution platform that enables users to design studies, collect responses from targeted audiences, and analyze results. The Service includes AI-powered study generation, audience targeting, response collection, and data analytics features.

You retain ownership of the studies you create and the data you collect through the Service. However, by using the Service, you grant us a limited license to process, store, and transmit your content as necessary to operate and improve the Service.
You are solely responsible for ensuring your studies comply with all applicable data protection and privacy laws, including but not limited to GDPR, CCPA, and any other relevant regulations in your jurisdiction.
Certain features of the Service require payment. All fees are quoted in U.S. dollars and are non-refundable except as expressly stated herein. All fees are final upon payment.
We use third-party payment processors (such as Stripe) to handle transactions. By making a purchase, you agree to the payment processor's terms and conditions.
The Service offers AI-powered study generation features. While we strive to produce high-quality suggestions, AI-generated content is provided "as-is." You are responsible for reviewing and editing any AI-generated study content before distribution. We make no guarantees about the accuracy, appropriateness, or completeness of AI-generated content.
The Service, including its design, features, code, and branding, is the property of Acuity and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
Your use of the Service is also governed by our data handling practices. We collect and process personal information necessary to provide the Service, including your account details, study content, and usage data. We do not sell your personal information to third parties.
To the fullest extent permitted by law, Acuity shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to loss of data, loss of revenue, or business interruption.
Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
We reserve the right to suspend or terminate your account at our discretion if you violate these terms or engage in activity that could harm the Service or other users. You may delete your account at any time through the Settings page. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.
We may update these Terms of Service from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
These Terms of Service are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved in the courts of competent jurisdiction.
